1) Sponsor; How to Contact Us

Sponsor: American Pump & Drilling.
Mailing or email contact information is provided on the Giveaway landing page and entry form. All notices and requests regarding this Giveaway should be submitted using the contact information listed there.

2) Eligibility

Age/Residency: Open only to legal residents of Idaho, Wyoming, or Montana who are 18 years or older at time of entry.

Rural Property Requirement: Entrant must be a rural property owner (not a renter) with a property located within our service area (defined below).

Service Area Definition (Clarified): The eligible property must be located within a 150-mile radius of Sponsor’s primary operations center in Ucon, Idaho. Sponsor will determine eligibility in its sole reasonable discretion using commonly accepted mapping tools and road-access considerations. Properties outside this radius are not eligible.

Decision-Maker: Entrant must be the primary decision-maker for the property’s water system purchases and upgrades.

Exclusions: Employees, officers, directors, and contractors of Sponsor and their immediate family/household members are not eligible.

Void Where Prohibited: Giveaway is void outside the eligible territories and where restricted by law.

Sponsor may require proof of eligibility, including government-issued ID, proof of property ownership, evidence that the property falls within the 150-mile radius of Ucon, Idaho, and/or reasonable documentation confirming rural location within the service area. Failure to timely provide proof may result in disqualification.

3) Giveaway Period; No Purchase Necessary

• Giveaway Period: Begins at the date/time stated on the Giveaway landing page and ends 14 days later (the “Entry Period”).

• No Purchase Necessary: Making a purchase will not increase your odds of winning.

• One Entry Per Property/Household: Limit one (1) entry per rural property/household. Duplicate or fraudulent entries are void.

4) How to Enter

Complete the official entry form during the Entry Period with accurate, truthful information, including name, email, phone, property address, basic system details, and any other fields noted as required.

Referral Entry (Double-Win Mechanic)

• To be eligible as a referrer if your referred entrant wins, the entrant must list the referrer on the official entry form at the time of submission.

• Referrer information cannot be added, changed, or corrected after submission.

• Self-referrals are not valid.

• A referrer must independently satisfy all eligibility requirements in Section 2.

• If multiple parties are listed as referrer for the same entrant, only the first valid referrer recorded by Sponsor’s system will be recognized.

Entries that are incomplete, inaccurate, illegible, automated, bulk, tampered with, or submitted using multiple/false identities are void. Sponsor may disqualify anyone believed to be interfering with the proper operation of the Giveaway.

5) Prizes; Approximate Retail Value (ARV)

Grand Prizes

• Prize: A complete pump system package for an eligible rural property, including equipment, controls, professional installation, testing, and commissioning, up to a maximum value of $10,000 (the “Prize Cap”).

• ARV: Up to $10,000 per winner. Prizes have no cash value and are non-transferable. No substitution except by Sponsor, in Sponsor’s sole discretion, for a prize of equal or greater value when reasonably necessary.

Double-Win Mechanic

If an eligible entrant is selected as a Grand Prize winner, and they listed a valid referrer on their entry, the listed referrer (if eligible) will also receive an identical pump system prize up to the Prize Cap for their property. Maximum of two (2) total winners will be awarded under this mechanic (i.e., initial winner and their valid referrer). If no valid referrer is tied to the winner, only the primary winner receives a prize.

“Pump Winner’s Bonus” (Non-Winners)

Eligible non-winners may receive a time-limited Pump Winner’s Bonus: 20% off up to a $10,000 job for a complete pump system if scheduled within 5 days of Giveaway close. This is subject to availability/capacity, cannot be combined with other offers, has no cash value, and may be modified or withdrawn in Sponsor’s discretion where legally permitted.

6) Scope of Prize; Costs Above the Prize Cap

• The prize covers standard pump system equipment and installation as designed by Sponsor for the winner’s property needs, up to $10,000 total value.

• If drilling, materials, depth, electrical upgrades, trenching length, or any other project requirement causes total cost to exceed $10,000, the winner is responsible for the entire difference above $10,000.

• Examples of potential extra-cost items (non-exhaustive): additional drilling depth/diameter; re-drilling or abandonment; casing upgrades; extended trenching; rocky/ledgy excavation; well rehabilitation; unexpected dewatering or grouting; panel/service upgrades, new circuits, or code corrections; permits/impact fees beyond standard allowance; water treatment/filtration/softening; larger or additional tanks; winterization; restoration/landscaping; access road building; crane time beyond standard; generator power; or other atypical site conditions.

• Sponsor will disclose any expected overage prior to installation. Winner may decline to proceed with overages; in that case, Sponsor may (in its discretion) redesign the scope to fit the Prize Cap or offer an alternate prize of comparable value.

7) Site Suitability; Permits; Scheduling; Winner Obligations

• Site & System Suitability: Prize assumes an existing, functional well or a feasible drilling location/plan. Sponsor may conduct a site assessment to confirm feasibility, access, and safety. If site conditions render installation impracticable, unlawful, or unsafe, Sponsor may, at its discretion, (a) re-scope the project to a feasible solution within the Prize Cap; (b) offer a credit toward eligible services; or (c) award an alternate prize of comparable value.

• Permits & Utility Locates: Sponsor will perform or coordinate standard 811 utility locates and typical permits for standard scope. Fees or activities beyond standard allowances are winner’s responsibility.

• Access & Safety: Winner must provide safe, lawful access, including gating codes, clear site access, secured pets/livestock, and reasonable staging.

• Scheduling: Winners must be available for site assessment and scheduling; installation must begin within 60 days of winner verification, subject to weather, force majeure, and permitting. Sponsor targets installation within 2 business days of winner selection where feasible for standard scope but may adjust for logistics, capacity, and lawful requirements.

• Cooperation: Winners must sign standard work orders and acknowledgments, and approve any overages before work commences.

8) Winner Selection; Verification; Odds

• Selection: Winners are selected at random from eligible entries and announced within 24 hours after the Giveaway closes.

• Notification/Response: Winners will be notified via phone and email and must respond within 48 hours with all requested information and documentation (e.g., W-9, proof of ownership, eligibility). Failure to respond or complete verification may result in forfeiture and selection of an alternate.

• Odds: Odds depend on the number of eligible entries received. The double-win mechanic does not increase the odds of the initial random draw; it provides for a second prize to a valid referrer tied to the drawn winner.

• Disqualification: Sponsor may disqualify entrants for fraud, non-eligibility, rule violations, or interference with the Giveaway.

9) Taxes & Reporting

• Winners are responsible for all taxes (including income and property taxes) and any costs above the Prize Cap.

• Sponsor may issue an IRS Form 1099-MISC for the ARV of the prize. Winners must complete and return a Form W-9 (or equivalent) and any other reasonably required tax forms as a condition of receiving the prize.

10) Warranties; Insurance; Liability Limits

• Workmanship/Warranty: Prize installations include Sponsor’s standard workmanship and equipment warranties applicable to the installed system. Warranty documentation will be provided at project closeout.

• Insurance: Sponsor maintains customary general liability insurance and utilizes licensed/bonded personnel where required.

• LIMITATION OF LIABILITY: To the maximum extent permitted by law, Sponsor’s total liability in connection with the Giveaway and any prize shall not exceed the ARV of the prize awarded (up to $10,000). Sponsor is not responsible for technical failures, lost/late/misdirected communications, internet or platform outages, unauthorized access, or force majeure events (including weather, wildfires, labor disputes, acts of God).

• ASSUMPTION OF RISK: Winner acknowledges inherent risks of construction/installation activities and agrees to follow site-safety directions and maintain safe site conditions.

11) Publicity; Intellectual Property

• Publicity Release: By accepting a prize, winners and valid referrers grant Sponsor a perpetual, worldwide, royalty-free right to use their name, city/state, likeness, voice, testimonials, and before/after photos/videos for advertising and promotional purposes in any media, without additional compensation, unless prohibited by law.

• Content Ownership: All Giveaway materials and content are owned by Sponsor. Entrants assign to Sponsor any rights in entry-related content submitted (excluding personally identifying information governed by the Privacy section) for Giveaway administration and promotional use.

12) Privacy; Data Practices

We collect and process:

• Personal data: name, email, phone, property address;

• Property/system data: ownership status, water system details, operation type;

• Automatically collected data: IP address, browser/device data, engagement metrics;

• Referral data: sharing activity and referral relationships.

Uses: Giveaway administration, eligibility verification, winner selection, customer communications, marketing (email/SMS with consent), analytics, fraud prevention, and service improvement.
Protection: We use industry-standard administrative, technical, and physical safeguards and restrict access to authorized personnel. We do not sell or rent personal data to third parties.
Your Choices: You may request access/correction, opt-out of marketing, or request deletion (subject to legal retention obligations).
SMS/Email Consent: If you opt in to SMS/email, you consent to receive communications; message/data rates may apply. You can opt out at any time (e.g., reply STOP for SMS).

13) Code of Conduct; Disqualification

Sponsor may disqualify any entrant who:

• Submits false, misleading, or incomplete information;

• Attempts to tamper with systems, automate entries, or circumvent limits;

• Harasses staff, makes threats, or interferes with other entrants;

• Violates applicable laws or these Terms.

Disqualification may include voiding entries, forfeiting prizes, and banning from future promotions.

14) Disputes; Governing Law; Arbitration

• Governing Law: These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules.

• Arbitration: Except for claims eligible for small-claims court, any dispute arising from or relating to the Giveaway or these Terms shall be resolved by binding arbitration administered by a recognized arbitral forum in Bonneville County, Idaho.

• Class Action Waiver: Proceedings will be conducted on an individual basis only; class actions and class arbitrations are not permitted.

• Small Claims: Either party may bring a qualifying claim in small-claims court in Bonneville County, Idaho (or the county of the entrant’s residence within ID/WY/MT where jurisdictionally permitted).

• Injunctive Relief: Sponsor may seek injunctive or equitable relief in a court of competent jurisdiction to protect IP or enforce publicity rights.

15) Cancellation; Modification; Substitution

If the Giveaway cannot be conducted as planned due to force majeure, fraud, technical failures, or any cause beyond Sponsor’s control, Sponsor may cancel, terminate, modify, or suspend the Giveaway and, if feasible, select winners from eligible, non-suspect entries received before the action or apply a fair alternative method. Sponsor may substituteany prize with one of equal or greater value when reasonably necessary.

16) Installation Acceptance; Completion; Title

• Acceptance: Upon installation and testing, winner (or authorized representative) will sign a completion/acceptance form.

• Title/Risk of Loss: Title to installed equipment passes per the work order and applicable law upon completion/acceptance.

• Post-Installation Support: Sponsor will provide standard warranty service per its then-current policies.

17) Miscellaneous

• Entire Agreement: These Terms and the entry form constitute the entire agreement regarding the Giveaway and supersede prior or contemporaneous communications.

• Severability: If any provision is held invalid, the remaining provisions remain in effect.

• No Waiver: Failure to enforce any term is not a waiver.

• Assignment: Sponsor may assign these Terms; entrants may not assign rights or obligations hereunder.

• Headings: Headings are for convenience only.

18) Summary of Key Conditions (Non-Exhaustive Convenience Summary)

• Up to $10,000 toward a complete pump system (equipment + standard installation). Winner pays any amount over $10,000.

• Double-win: If the winner listed you as referrer on their original entry (or they used your unique link) and you meet eligibility, you also win the same prize (up to $10,000). Referrer must be listed at time of entry; no later changes.

• Two winners guaranteed under the double-win mechanic (winner + valid referrer).

• One entry per property/household; rural owners only; service area limited to Eastern ID / Western WY / Southern MT.

• Taxes and any overages are the winner’s responsibility; W-9 required; Sponsor may issue 1099-MISC.

• Installation must begin within 60 days of verification; scheduling subject to weather, permits, lawful requirements, capacity, and site suitability.

BY PARTICIPATING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS.
